What is mediation?

Mediation is the practice of reconciling different interests between two or more parties in disagreement, with the help of a neutral expert. The mediator gently provides vital information and guidance, de-escalates conflict, prepares an agenda of relevant items, helps with financial documents and facilitates constructive dialogue. This leads to mutually desirable solutions, without the need for litigation or court decisions. Mediation works in difficult cases, where a resolution may seem impossible, and it is also helpful in less adversarial cases where the parties simply require help with formalizing their decisions into a legal agreement.

Does a mediator make decisions?

No. A mediator is an impartial facilitator for both parties, working to support and guide them through the decision making process, towards a durable and fair solution.

How much does mediation cost?

Mediation is a significant cost saving practice, particularly when compared to litigation or going to court. Fees are calculated on an hourly basis and therefore influenced by the parties and the number of issues mediated. The Way Mediation’s fees are very reasonable. Call for details.

What issues can be resolved through mediation?

Family Mediation: separation and divorce; including parenting schedules, property divisions, equalization payments, spousal support, child support, decision making in regards to children, elder care, and all other relevant family issues.

What if my case is really difficult?

If you are facing a very high conflict case or an extreme clash of personalities, mediation can be of especially significant assistance in helping de-escalate strife and reduce potential expenses. A mediator always screens a given matter to determine that it is suitable for mediation.

How does the process of mediation work?

The process is flexible in order to suit a variety of cases and individuals, but it generally begins with an intake component, where the mediator collects information, screens the case and answers questions to ensure everyone is comfortable before proceeding. A report may be written and an agenda set to help inform the mediation talks and keep track of progress. As the facilitated discussions begin, the mediator makes introductory remarks and supports all parties in working towards peace. The discussions develop from identification of the problems, to brainstorming and generating options. Before concluding, the mediator drafts a Memorandum of Understanding containing the parties’ decisions and helps explore the final steps needed to achieve a durable and fair resolution.
